Affiliate program terms

The dontapplyai affiliate program is run by dontapply.ai, Inc., 2100 Geng Road, Suite 210, Palo Alto, CA 94303. Anything these terms do not cover is governed by our terms of service.

1. Who can join

The program is for recruiters who have worked in recruitment for at least six months, have a public presence on LinkedIn, and are self-employed or work through a registered company or LLC. You must be at least 18. What you tell us when you apply must be true, and you must keep it up to date.

2. Approval

Every account needs our approval, and you must first confirm your email address. We may approve or decline any application without giving a reason. We limit how many affiliates we work with at a time, so an application may wait until the program has room. Until we approve you, you cannot make links or earn commission.

3. Your links and codes

Once approved, you can make up to 50 links. Each link gets a random name, which you can change to a name of your own; the old name keeps working. Every link opens our home page. A link's name is also a promotion code, which gives a company 10% off its first three months, or its first year if it pays yearly, and works only on its first payment. A company that arrives through your link has the code filled in at checkout. We may refuse or remove a name, for example one that uses our name or someone else's.

4. Which companies are yours

A company is yours if it creates its account within 90 days of clicking one of your links. If it clicked more than one affiliate link, the last one counts. A company that creates its account without a link is yours if it pays with one of your codes on its first payment. A company that already had an account when it clicked is not yours. We decide who a company belongs to, and what is due, from our records.

5. Commission

You earn 15% of what each of your companies pays us, before tax and after discounts, for its first 12 months of paid service: every payment for a billing period that begins within 12 months of the start of the first period it paid for. A yearly plan therefore earns on its first year only. Contracts arranged directly with us, such as Enterprise, are outside the program unless we agree otherwise in writing.

6. When we pay

We pay commission on a company only once it has been paying us for three months, counted from its first payment, so a free trial or any other free period does not count. If the company has stopped paying by then, you earn nothing for it, including for the payments it made. After that, each new commission is held for 30 days. We pay in US dollars each month by Wise or PayPal, to the address you gave, once $100 or more is due.

7. Tax

You are responsible for all taxes on what you earn, and for any registration your work needs. Before the first payment you send a W-9 (United States) or a W-8BEN (anywhere else). We pay nothing until we have it, and we withhold tax where the law requires us to.

8. Refunds and disputes

If we refund all or part of a payment, the same share of the commission on it is cancelled. If a company disputes a payment with its bank or card issuer, the whole commission on that payment is cancelled when the dispute is opened, and it is not restored whatever the outcome. If a cancelled commission was paid to you already, it is taken off your next payment.

9. Rules

You must follow our promotion guidelines, which are part of these terms. You may not refer yourself or your own company, and you may not make promises on our behalf.

10. Pausing and ending

We may pause or close your account at any time. While it is paused, payments earn no commission and payouts wait. If we close it because you broke these terms or the guidelines, or gave us false details, commission not yet paid to you is forfeited, and we may take back commission earned by breaking them. If we close it for any other reason, or you leave by writing to us, what is due is paid at the next payout if it reaches $100.

11. Liability

We provide the program as it is, and we may change or end it. We are not liable for lost profits or indirect losses, and our total liability to you under these terms is limited to the commission paid or due to you in the 12 months before the claim.

12. Changes

We may change these terms or end the program. We email you 30 days before a change or the end takes effect. If you stay in the program after that, you accept the change.

13. Our relationship

You are an independent contractor. Nothing here makes you our employee, agent or partner, and you cannot make commitments for us.
